Terms of Agreement
Madrilena Metals reserves the right to use any and all photographs of any buyer's item, finished or unfinished, for promotional purposes. This includes but is not limited to: Madrilena Metals business pages, the personal social media accounts of Madrilena Metals sole owner, Sarah Murphy, websites to facilitate sales, and any advertising campains Madrilena Metals is currently involved in or will be involved in at a later date.
However, Madrilena Metals will never use any identifying personal information of any customer, regardless of sale specifics or outcome, without express written permission from said customer. This includes full names, addresses, email addresses, payment information, social media accounts, and phone numbers. If such a violation occurs, the customer must send valid proof of a breach in confidentiality within 72 hours of content being published. If Madrilena Metals is proven to be responsible for the violation, the content will be removed within the shortest available time-frame and to the best of this company's ability.
(Madrilena Metals and/or Sarah Murphy are not liable for and do not guarantee any removal of content posted by persons or entities separate from Madrilena Metals and/or its sole owner.)
In the case of a valid confidentiality breach, the customer will be billed for 0% of the cost of their initial purchase item, regardless of original customization requests or purchase status. This DOES NOT include aforementioned deposit. Madrilena Metals will still complete the commissioned item within a reasonable period of time according to the initial specifications made by the buyer. No changes will be made to the item after the initial customization request was received under any circumstances. The customer will then be notified when the item ships.
Neither party is required to continue communication of any type after the item has been received, however both Madrilena Metals and the buyer agree to refrain from any slanderous, untrue, incorrect, hateful, or defamatory statements or actions regarding any and/or all parties involved. This includes the personal and business accounts of Madrilena Metals, Sarah Murphy, the customer, and any business or legal entities associated with the customer.
By engaging in any financial agreement whatsoever with Madrilena Metals or through Sarah Murphy as sole owner, the buyer hereby agrees to refrain from taking any direct legal action against aforementioned company and/or Sarah Murphy.
This includes both civil and criminal court, with the exception of crimes involving:
-acts of bodily harm, abuse, or violence in any capacity
-illegal possession of a firearm
- mistreatment of a vulnerable adult as defined by the law
- mistreatment, abuse, or neglect of a child as defined by the law
-fraud or theft by any party associated with this sale
Sarah Murphy, and by extension Madrilena Metals, is not responsible for independent actions taken by either a state or federal law enforcement agency not related to the express business purposes previously stated.
